Terms of service

  1. Introduction.
    The Products (the “Product” or “Products”) marketed on the website www.caseificiosansimone.com (the “Website”) are offered and sold by Caseificio San Simone s.r.l., with registered office in Reggio Emilia, Via F. Garcia Lorca no. 18, Tax Code/VAT Number and Business Register number 02919990354 (the “Caseificio”).
    Sales of the Products listed on the Website are carried out by the Caseificio in Italy and Europe.
    These general terms and conditions govern their operation from the moment they are accepted.
    The Customer (the “Customer”) views, understands and accepts these general terms and conditions without reservation during the registration procedure and/or the completion of a purchase order (the “Order”).
    The offer and sale of the Products on the Website by the Caseificio constitute a distance contract governed by Chapter I, Title III (Articles 45 et seq.) of Legislative Decree no. 206 of 6 September 2005, otherwise known as the Consumer Code, and by Legislative Decree no. 70/2003 concerning the regulation of electronic commerce.
    The applicable General Terms and Conditions of Sale are those in force on the date the purchase order is sent.
    A Customer who accesses the Website to make purchases must carefully read these General Terms and Conditions before sending the order. The General Terms and Conditions are always available to the Customer on the Website in the Terms of Sale section so that they can be consulted, reproduced or stored at any time.
  2. Customer registration.
    To complete purchases on the Website, the Customer must be registered and therefore have a personal account. Registration is free and takes place directly online on the Website through a guided procedure. It requires the Customer to provide certain information, including, by way of example and without limitation, first and last name and email address. The Caseificio will confirm the Customer’s registration by means of a specific confirmation email.
    The Customer undertakes to:
    – provide the personal information (“Registration Data”) requested during this procedure, ensuring that it is current, complete and truthful;
    – provide their own personal details and telephone and email contact details, and not those of third parties and/or fictitious details, failing which the Caseificio may, at its sole and independent discretion, delete the Customer’s account;
    – promptly and constantly update the Registration Data so that it is always current, complete and truthful.
    Once the registration procedure has been completed, the Customer is assigned an Account consisting of a Customer Identification code and a Password, which are confidential and strictly personal.
    The Customer is solely and exclusively responsible for keeping and correctly using the access credentials for their Account and therefore undertakes to log in and log out correctly and carefully, to immediately notify the Caseificio of any unauthorized use of their Account and of any other breach of the security rules of which they become aware.
    The Caseificio may not in any way be held liable for any damage arising from failure to comply with these Registration Conditions, since the Customer is aware that, in order to regulate access to the service, their authentication is based exclusively on verification of the Customer Identification code and Password.
    The User is therefore responsible for any harmful consequence or prejudice that may result, to the Caseificio or third parties, from the incorrect use, loss, theft and/or compromise of the confidentiality of the Customer Identification code and Password.
    If the Customer provides information that is untrue, inaccurate, not current or incomplete, or if the Caseificio believes, at its sole discretion, that the information provided by the Customer is untrue, inaccurate, not current or incomplete, the Caseificio will nevertheless have the right to deactivate the Customer’s account, either temporarily or permanently, preventing any subsequent use of the Service.
    The Caseificio reserves the right to refuse or cancel orders placed by:
    – a Customer with whom it is involved in a legal dispute; a Customer who has previously breached the conditions and/or terms of the purchase contract with the Caseificio;
    – a Customer who has been involved in fraud of any kind and, in particular, payment-card fraud;
    – a Customer who has provided false, incomplete or otherwise inaccurate identification data, or who has not promptly sent the Caseificio the information and/or documents requested by it, or who has sent invalid documents.
    All operations carried out through the User Account automatically relate the operations performed and requests made to that account under these General Terms and Conditions, without exception.
    Registration entails acceptance of the processing of data by the Caseificio in compliance with the rules on the protection of personal data, as set out in a separate privacy notice that can always be consulted and/or amended in the Terms of Sale section.
    All data provided by the Customer will be processed by the Caseificio and the Data Controller in compliance with the applicable privacy legislation, namely Legislative Decree 196/2003, coordinated with the amendments introduced by Legislative Decree 101/2018 pursuant to EU Regulation 2016/679, which entered into force on 25 May 2018.
  3. Purchase order.
    The purchase procedure is entirely electronic.
    In the relevant section of the Website, called online sales, the Customer can check the type, characteristics, quantities and availability of the Products for sale.
    To make a purchase, the Customer must visit the Website, access the relevant section called online sales by entering the Customer Identification and Password account credentials already in their possession, complete and send the electronic order form by choosing the Product/Products they intend to purchase, read the General Terms and Conditions and Privacy Policy and confirm acceptance of them, complete the purchase by entering the address where the Products must be delivered, which may also differ from their residential address, and, where applicable, billing details, select the desired payment method and make the payment, reread everything, confirm and send the order electronically to the Caseificio.
    The sales contract is deemed concluded when the order form reaches the Caseificio’s server. Therefore, before electronically transmitting the purchase order, the Customer can identify and correct any data-entry errors by following the guided instructions on the Website.
    Once the purchase order has reached the Caseificio, it is registered and confirmed to the Customer by an appropriate email sent to the email address provided by the User, containing confirmation of the order and a summary of the general purchase details.
    By sending the order to the Caseificio, the Customer confirms that they have read all the information provided during the purchase procedure and fully accept these General Terms and Conditions and the stated payment terms.
    The purchase order constitutes a contractual offer that is not binding on the Caseificio, which also reserves the right to unilaterally revoke the order and refund the price paid.
  4. Product information.
    Information and characteristics relating to the Products are available on the Website.
    Each Product for sale is advertised and described by means of a photograph and a Product information sheet. The Caseificio specifies that the image of each Product is intended solely as a presentation for sale and therefore the Product shown in the image may not correspond perfectly, in terms of colour and displayed dimensions, to the final Product purchased. Compliance with the characteristics and quality of each Product as described in the Product information sheet is guaranteed.
  5. Prices, payment methods and shipping.
    The price of each Product is expressed in euros, including all taxes and duties, and is indicated next to/below its image and in any case in the Product information sheet.
    The final total price of the selected Product/Products will be charged to the Customer once the purchase order has been confirmed.
    Orders may be paid by credit card (Visa, Mastercard, Satispay, Discover, Diners Club, JCB and PostePay cards are accepted), prepaid cards, PayPal or Stripe Payments.
    Payment in cash is also accepted, within the limits established by the law in force at the time of the transaction, or cash on delivery to the courier, with a one-time additional surcharge of €8.00.
    Shipping costs, including shipping costs for returns relating to the exercise of the right of withdrawal, are entirely free for the Customer.
    The Products listed in the purchase order are shipped exclusively within Italy by national courier to the place indicated in the purchase order.
    The indicative delivery times for Italy are at least 24 hours (2 days), excluding the day on which the goods depart, and in any case depend on the courier’s availability and working conditions, strikes, bad weather, special events and critical periods.
    Please note that the courier will deliver the goods to the Customer at street level and not directly to the residential floor.
  6. Right of withdrawal and its exercise.
    Under Article 52 of Legislative Decree no. 206/2005 (Consumer Code), subject to the exceptions in Article 59, the Customer has a period of 14 (fourteen) days to withdraw from a distance contract or a contract negotiated away from business premises without having to provide any reason and without having to bear costs other than those provided for in Article 56, paragraph 2, and Article 57 of the aforementioned Legislative Decree.
    Exercising the right of withdrawal requires the Customer to send the Caseificio a communication either before receiving the Products or within 14 days from the date of delivery of the Products.
    The communication must be sent by registered letter with return receipt, addressed to Caseificio San Simone s.r.l., Via F. Garcia Lorca no. 18 – 42122 Reggio Emilia.
    The Products must be returned by the Customer at the Caseificio’s expense and following the instructions provided by the Caseificio regarding the method of returning the Products.
    The right of withdrawal may be exercised for the entire purchase order placed by the Customer and never for components or parts of it.
    The Caseificio will refund the Customer the full amount of the returned goods, including shipping costs where applicable, within 14 days from the date on which the withdrawal notice was received, without prejudice to the Caseificio’s right to suspend the refund until the returned Products have actually been returned. The refund will be made exclusively to the Customer by bank transfer to the bank account in the Customer’s name provided by them.
  7. Complaints
    Any complaint must be sent by registered letter with return receipt to Caseificio San Simone s.r.l., Via F. Garcia Lorca no. 18 – 42122 Reggio Emilia.
  8. Applicable law and competent court
    The sales contract between the Customer and the Caseificio is governed by Italian law. For the resolution of disputes relating to the interpretation, performance or termination of these General Terms and Conditions or individual purchase orders, if the Customer is a consumer under the Consumer Code, exclusive jurisdiction will lie with the court of the Customer’s municipality of residence or domicile if located in Italy; in all other cases, territorial jurisdiction will lie exclusively with the Court of Reggio Emilia, with any other competent court excluded.
    Pursuant to Article 1341 of the Italian Civil Code, the Customer declares that they have read and specifically accept the following articles of these General Terms and Conditions: 1, 2, 3, 4, 5, 6, 7 and 8.
